1. Introduction
These Terms govern the use of the Fiscal IQ service provided by Kávozrnko, s. r. o.
By using the Service, you agree to these Terms.
2. Nature of the Service
Fiscal IQ provides automated VAT scenario analysis, VAT number validation, and VAT threshold tracking tools.
The Service is informational only and does not constitute tax, accounting, or legal advice.
3. No Professional Advice
Users remain solely responsible for:
- VAT compliance
- Registration obligations
- Reporting and filings
- Verifying applicable tax laws
Fiscal IQ shall not be relied upon as a substitute for professional advice.
4. Service Tiers
The Service may include:
- A free version
- A Pro version with additional features
Access to Pro features is subject to a separate subscription agreement concluded via our website.
The mobile application itself does not process payments.
5. VIES Dependency
VAT validation results depend on the EU VIES system.
We do not guarantee accuracy, availability, or uninterrupted access.
6. User Responsibilities
You are responsible for:
- Accuracy of all data entered
- Lawful processing of invoice data
- Maintaining security of your credentials
7. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages
- We are not liable for tax penalties or regulatory fines
- Our total liability is limited to the amount paid by the user in the previous 12 months
Nothing excludes liability where prohibited by law.
8. Account Termination
We may suspend accounts for misuse.
Users may terminate their account at any time via in-app settings.
9. Data Processing Addendum
For users who store invoice data under the Pro version, the Data Processing Addendum below applies.
10. Governing Law
These Terms are governed by Slovak law.
Disputes shall be resolved by Slovak courts.
DATA PROCESSING ADDENDUM
1. Roles
For stored invoice data:
- User = Data Controller
- Fiscal IQ = Data Processor
2. Processing Scope
Processing includes:
- Storage
- Organization
- Retrieval
- Deletion
Purpose: providing invoice management functionality.
3. Processor Obligations
Fiscal IQ shall:
- Process data only per user instructions
- Ensure confidentiality
- Implement appropriate security
- Notify of breaches without undue delay
- Delete data upon termination
4. Subprocessors
We may use EU-based infrastructure providers.
We remain responsible for their compliance.
5. Data Deletion
Upon termination of subscription:
- Invoice data deleted within 30 days
- Backups overwritten per retention policy
